Welcome to Koala Education Consultants (Kenya). These Terms & Conditions ("Terms") govern use of the website (koalaeducation.co.ke) and all services provided by Koala Education Consultants (Kenya) ("Koala", "we", "us", "our"), located at 4th Floor, Grenadier Tower, Woodvale Grove, Westlands, Nairobi, Kenya. Scope of Services and Eligibility
Koala provides education consultancy services to guide students from East and West Africa to Australian universities, including:
- Free initial consultations and appointment bookings.
- University application assistance.
- Open days and education fair RSVPs.
Eligibility: Users must be 18 years or older, or have parental/guardian consent if under 18. Services unavailable where prohibited by law.
Appointments, Applications, and Event RSVPs
Appointments: Book via online form. Cancellations/rescheduling require 24 hours' notice via email or phone. No-shows may result in priority booking restrictions.
Applications: Koala assists with document preparation and submission. Clients must provide accurate information and documents. Processing fees apply post-agreement (if applicable).
RSVPs: Event confirmations are binding. Changes/cancellations via email 48 hours prior. Koala reserves right to cancel events.
Fees, Payments, and Refund Policy
Initial consultations: Free.
Application processing: No refunds after application submission to universities or services rendered. All payments in KES via approved methods.
Payment methods: Bank transfer, M-Pesa, or other approved methods (all in KES).
Refunds: No refunds after application submission to universities or services rendered.
No Visa or Legal Guarantees
Koala has 25+ years' experience with high visa success rates based on past client outcomes. However, Koala provides no guarantees of visa approval, admission, or legal outcomes. Success depends on university decisions, immigration authorities, and client circumstances. Koala offers guidance only, not legal/immigration advice.
Intellectual Property and User Content
All website content, logos, materials are owned by Koala or licensors. Users granted limited, non-exclusive license for personal use.
User-submitted materials (forms, documents) grant Koala a royalty-free license to use for service delivery. Users retain ownership but warrant no infringement.
Limitation of Liability and Indemnities
Liability limited to fees paid by client. Koala not liable for indirect, consequential, or punitive damages (e.g., lost opportunities).
Clients indemnify Koala against claims from inaccurate information or third-party actions.
Governing Law and Dispute Resolution
Governed by laws of the Republic of Kenya. Disputes first attempted via mediation in Nairobi. Unresolved disputes to Kenyan courts in Nairobi.
Amendments and Notices
Koala may update Terms; changes posted here with effective date. Continued use constitutes acceptance. Notices via email or website.
Severability and Entire Agreement
Invalid provisions severed without affecting remainder. These Terms constitute complete agreement, superseding prior understandings.
